ASHEVILLE, N.C. (828NewsNow.com) — A Buncombe County man was sentenced to at least 2 1/2 years and up to four years in state prison after having a violent dispute over a parking space.
According to a Nov. 4 news release from the Buncombe County District Attorney’s Office, Brandon Derelle Boone, 38, pleaded guilty in Buncombe County Superior Court to assault with a deadly weapon inflicting serious injury and possession of a firearm by a felon.
Superior Court Judge Alan Thornburg sentenced Boone to one consolidated active prison term of 30 to 48 months in the North Carolina Department of Adult Correction, the release said.
North Carolina law strictly prohibits individuals with prior felony convictions from possessing firearms. Boone was previously convicted of robbery with a dangerous weapon in 2011, the District Attorney’s Office said.
According to court records, the charges stem from a March 28 altercation between Boone and an adult male victim regarding a parking space. During the argument, Boone produced a handgun and struck the victim in the face, causing a facial laceration and a fractured orbital bone. Boone also discharged the firearm into the air during the encounter, Asheville police said in its report.
The victim, who made a full recovery, was consulted pursuant to the North Carolina Crime Victims’ Rights Act and approved the plea arrangement, the release said.
Officers with the Asheville Police Department who were conducting routine patrols nearby arrived at the scene and arrested Boone and his wife without incident, the District Attorney’s Office said.
